
The Small Claims Court has civil jurisdiction over monetary claims up to $25,000. The Small Claims Court has a set of rules that govern how cases are to be conducted in terms of deadlines and timelines, types of court documents and forms, serving or filing court documents and other procedural steps regarding the court hearings.

The litigation process includes several steps. It starts with preparing the Plaintiff’s Claim or Defence. There are special requirements for serving court documents, depending on the document served, the legal entity to be served and the timelines for service. A mandatory Settlement Conference is held in all defended actions. If the action is not defended judgement can be signed by the court by way of default judgement or at an Assessment Hearing. The Trial is the last step, when a settlement in not reached at the Settlement Conference or until the commencement of trial.
